1. INTRODUCTION

Welcome to www.wearebetterway.eu (the "Platform"). These Terms of Service ("Terms") govern your use of our community platform, website, online store, and related services. By accessing or using the Platform, or making a purchase, you agree to be bound by these Terms.

2. USER ACCOUNTS & REGISTRATION

2.1. Registration & Age Restriction: To access certain features (Crew system, Chat, Reviews, Profile management), you must register an account. You must be at least 16 years old to create a community account. To make purchases in the online store, you must be at least 18 years old or have the consent of a parent or legal guardian.

2.2. Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

2.3. Termination: We reserve the right to suspend or terminate your account if you violate these Terms, specifically regarding community conduct or fraudulent activities.

3. COMMUNITY CONDUCT & RULES

To maintain a safe environment for car enthusiasts, you agree NOT to:

  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or promotes hate speech.
  • Spam the global chat, crew chats, or comments sections.
  • Impersonate others or provide false information.
  • Use bots, automated scripts, or exploit bugs to manipulate the Face-Off voting system, XP collection, or Crew Reputation mechanics.
  • Attempt to hack, disrupt, or compromise the integrity of the Platform.

4. REAL-WORLD MEETUPS & EVENTS (DISCLAIMER)

4.1. User-Organized Events: Users may organize real-world car meetups through the Platform's Crew System. The Operator (WeAreBetterway) is not a sponsor, organizer, or affiliate of these meetups.

4.2. Assumption of Risk: You attend such events entirely at your own risk. The Operator is not liable for any injuries, accidents, damages to vehicles, or legal violations (e.g., traffic infractions) that occur during these user-organized events. Always obey local traffic laws and respect public and private property.

5. VIRTUAL POINTS, XP, AND REPUTATION

5.1. No Monetary Value: The Platform utilizes a virtual experience and reputation system (XP, REP, Crew Levels, Perks). These virtual metrics have no real-world monetary value, cannot be purchased with real money, cannot be exchanged for cash, and remain the property of the Operator.

5.2. Modifications: We reserve the right to modify, reset, balance, or remove virtual points, levels, or perks at our sole discretion to maintain the fairness of the ecosystem.

6. USER-GENERATED CONTENT

6.1. Ownership: You retain ownership of the photos, reviews, and text you post on the Platform.

6.2. License: By posting content, you grant WeAreBetterway a non-exclusive, worldwide, royalty-free license to use, display, and reproduce your content within the Platform (e.g., displaying your car in the Garage, Face-Off, or Crew sections).

6.3. Responsibility: You are solely responsible for the content you upload. You confirm that you have the right to share such content and that it does not infringe on third-party rights. We reserve the right to remove any content reported by users without prior notice.

7. INTELLECTUAL PROPERTY

The WeAreBetterway brand, logo, design, code, and original graphics are the intellectual property of the Operator and are protected by copyright laws. You may not copy, scrape, or use them without our explicit written permission.

8. DISCLAIMER OF LIABILITY

8.1. The Platform is provided on an "AS IS" basis. We do not guarantee that the site will be uninterrupted or error-free.

8.2. Car Advice: Any technical advice, tuning discussions, or modifications discussed on the Platform are for informational purposes only. We are not liable for any damage to your vehicle, voided warranties, or safety issues resulting from information shared by community members.

9. EXTERNAL LINKS

Our Platform may contain links to third-party websites (e.g., Instagram, TikTok). We are not responsible for the content, privacy policies, or practices of these external sites.

10. ONLINE STORE & ORDERS

10.1. Product Display: We strive to display product colors and features accurately. However, actual colors may vary slightly depending on your monitor settings.

10.2. Order Placement: By placing an order through our checkout process, you are making a binding offer to purchase the selected items. A contract is legally formed only when we send you an Order Confirmation email.

10.3. Availability: All orders are subject to product availability. If an item becomes unavailable after your order is placed, we will notify you and issue a full refund for that item.

11. PRICING & PAYMENTS

11.1. Prices: All prices are displayed in Euros (€). The Operator is a Non-VAT Payer under Slovak law. The prices shown are final and do not include VAT.

11.2. Shipping Costs: Shipping costs are calculated at checkout based on your location and selected delivery method and are added to the total price.

11.3. Payments: We use secure third-party payment gateways (e.g., Stripe) to process your transactions. We do not store your credit card information. Payments must be completed before an order is dispatched.

12. SHIPPING & DELIVERY

12.1. Dispatch: We aim to process and dispatch orders within the timeframes specified on the product pages (typically 24-72 hours).

12.2. Delivery Times: Delivery times are estimates and depend on the carrier. We are not responsible for delays caused by customs clearance, local postal services, or unforeseen circumstances.

12.3. Risk of Loss: The risk of loss and damage to the goods passes to you when you (or a third party indicated by you) acquire physical possession of the goods.

13. RIGHT OF WITHDRAWAL (RETURNS & REFUNDS)

13.1. 14-Day Return Policy: As a consumer in the EU, you have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which you acquire physical possession of the goods.

13.2. Condition of Returned Goods: To be eligible for a refund, the item must be unworn, unwashed, and in its original packaging with all tags attached. We reserve the right to refuse returns that show signs of wear, smells, or damage.

13.3. Return Process: To exercise your right of withdrawal, you must inform us via email at customer@wearebetterway.eu. You are responsible for paying the return shipping costs.

13.4. Refunds: Once your return is received and inspected, we will issue a refund to your original payment method within 14 days.

14. DIGITAL PRODUCTS & GIFT CARDS

14.1. Delivery: Digital products, including Gift Cards, are delivered electronically to the email address provided at checkout.

14.2. Exceptions to the Right of Withdrawal: By purchasing a digital product or Gift Card and consenting to immediate delivery, you acknowledge that you lose your 14-day right of withdrawal once the digital content is provided or the Gift Card code is generated and sent.

14.3. Gift Card Usage: Gift cards cannot be exchanged for cash and are valid for purchases exclusively on the WeAreBetterway platform.

15. WARRANTIES & COMPLAINTS

15.1. Statutory Warranty: In accordance with EU law, we provide a 24-month statutory warranty on all physical goods against manufacturing defects.

15.2. Exceptions: The warranty does not cover normal wear and tear, improper washing/handling, or damage caused by the user.

15.3. Filing a Complaint: If you receive a defective item, please contact us immediately at customer@wearebetterway.eu with a description and photos of the defect. We will arrange for a replacement, repair, or refund as appropriate.

16. GOVERNING LAW & DISPUTES

These Terms shall be governed by and construed in accordance with the laws of the Slovak Republic (European Union). Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Slovak courts.

17. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Significant changes will be announced on the Platform. Continued use of the Platform constitutes acceptance of the new Terms.
